These Terms and Conditions ("Agreement") are entered into by and between you (the "Client" or "User") and Tabaruq Arts, a California nonprofit public benefit corporation with 501(c)(3) status, including its subsidiaries, fiscally sponsored projects, affiliated brands, and representatives including but not limited to Lionheart Collective LLC, Tahir Qawwal, and Alexandra Amïe Lyons (collectively, the "Company," "we," "our," or "us").
By accessing our website, purchasing, enrolling in, or otherwise participating in any program, product, or service provided by Tabaruq Arts or any affiliated entity, you agree to be legally bound by the terms and policies outlined herein.
OVERVIEW
This website is operated by Tabaruq Arts and its affiliates. Throughout the site, the terms "we," "us," and "our" refer collectively to Tabaruq Arts, Lionheart Collective LLC, Tahir Qawwal, Alexandra Amïe Lyons, and any subsidiaries or affiliated brands. We offer this website, including all information, tools, and services available herein, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

We reserve the right to refuse any order. You agree to provide current, complete, and accurate billing and account information and update it as needed.

We may offer access to third-party tools "as is" without warranties. Use is at your own risk and subject to the third party's terms.

SECTION 13 - CONFIDENTIALITY

SECTION 14 - INTELLECTUAL PROPERTY
All content and materials, including courses, methods, writings, media, recordings, and documentation, are the intellectual property of Tabaruq Arts, Lionheart Collective LLC, Tahir Qawwal, Alexandra Amïe Lyons, or their authorized licensors. You may not copy, share, or distribute without written consent.
SECTION 15 - DIGITAL PRODUCTS AND COACHING SERVICES
All purchases of digital products—including but not limited to courses, workshops, recordings, templates, meditations, documents, and other downloadable or streamable content—as well as coaching services—delivered in group, private, live, or asynchronous formats—are non-refundable, non-transferable, and subject to the delivery schedule as determined by the Company. No exceptions will be made to this zero-refund policy.
Client understands and agrees that:
Digital products and coaching services may be delivered in phases or via scheduled access. Company is under no obligation to provide immediate or full delivery upon purchase. Company reserves the right to determine the timing, format, and duration of delivery.
Unless a shorter duration is explicitly stated, 'lifetime access' refers solely to the lifetime of the specific program as operated by the Company and does not guarantee indefinite or perpetual availability.
Access and participation are non-transferable and may not be paused or deferred to a future cohort, program, or user.
Access to digital content does not constitute ownership. All materials are for personal use only and may not be reproduced, distributed, or repurposed without express written consent.
Coaching services are not medical, psychological, legal, or financial advice and do not replace professional care. Results are not guaranteed and depend on the Client’s implementation and responsibility.
Client agrees not to initiate chargebacks or payment disputes. In the event of a chargeback, the Company reserves the right to recover the full amount, plus a $250 administrative fee and all legal fees associated with the dispute.
Unauthorized use, sharing, or replication of any content may result in immediate revocation of access without refund and may be subject to legal action.
SECTION 16 - LIMITATION OF LIABILITY
All services are provided “as is.” We make no guarantees, representations, or warranties of any kind. In no event shall Tabaruq Arts, Lionheart Collective LLC, Tahir Qawwal, Alexandra Amïe Lyons, or any affiliates be held liable for damages, including indirect or consequential losses.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Tabaruq Arts, Lionheart Collective LLC, Tahir Qawwal, Alexandra Amïe Lyons, and all associated contractors, employees, agents, and affiliates from any liability or legal claims arising from your breach of these Terms or use of the services.
SECTION 18 - TERMINATION
We reserve the right to terminate any agreement if you breach these Terms or behave inappropriately toward our staff, representatives, or community. No refunds shall be issued, and all remaining payment obligations remain due.
SECTION 19 - GOVERNING LAW
These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved in the courts of Santa Cruz County, California. Client agrees that any dispute must be filed in Santa Cruz County, CA, and waives the right to bring claims in any other jurisdiction.
SECTION 20 - CHANGES TO TERMS
We may update these Terms at any time. Continued use of our website or services constitutes your agreement to all revisions.
SECTION 21 - ENTIRE AGREEMENT
These Terms represent the complete understanding between you and the Company. No prior agreements or understandings shall override these Terms. Ambiguities will not be construed against the drafting party.
If any provision is found unenforceable, the remainder shall continue in full force. All sections relating to intellectual property, payments, refunds, confidentiality, and limitations of liability shall survive the termination of this Agreement.
SECTION 22 - CLASS ACTION WAIVER
Client agrees that any disputes shall be conducted solely on an individual basis and not in a class, consolidated, or representative action.
SECTION 23 - NON-CIRCUMVENTION
Client agrees not to solicit or contract directly with any employee, contractor, or collaborator of Tabaruq Arts or its affiliates for services that are substantially similar to those offered under this Agreement for a period of 24 months following their last interaction.
SECTION 24 - DIGITAL SIGNATURE CONSENT
By checking a box, entering payment details, or otherwise engaging with our products or services, Client acknowledges and agrees to be bound by these Terms, which serve as a legally binding agreement in lieu of a physical signature.
SECTION 25 - NO PROFESSIONAL ADVICE DISCLAIMER
All content, coaching, and services provided by Tabaruq Arts, Lionheart Collective LLC, Tahir Qawwal, and Alexandra Amïe Lyons are intended for educational and informational purposes only. Nothing in our materials or programs constitutes professional advice, including but not limited to legal, medical, psychological, or financial advice.
You acknowledge and agree that:
You are solely responsible for any decisions, actions, or results arising from your use of our services.
The Company makes no guarantees regarding outcomes or earnings.
You should consult a qualified professional before making decisions that could impact your legal, financial, medical, or mental health status.
Use of our content and coaching is at your own discretion and risk.
